Spousal Open Work Permit in Canada

This permit lets you come to Canada, stay here, and work for any employer without needing an LMIA—opening up a world of job opportunities. Who Qualifies?
You can apply for a Spousal Open Work Permit if your spouse or common-law partner is:
- A skilled worker in Canada (typically working under NOC skill types O, A, or B) with a valid work permit.
- An international student enrolled at a university, college, or post-secondary school with a valid study permit.
- Applying for the Atlantic Immigration Pilot Program (AIPP) under NOC skill types O, A, or B.
- A foreign military member residing and working in Canada.
- A foreign representative in Canada.
Additional Requirements for the Applicant
- You must have sufficient funds to sustain yourself in Canada and enough resources to return home if needed.
- Undergo a medical exam to confirm you are in good health.
- Demonstrate that you have no criminal history and are not classified as a dangerous person.
- You should not be employed by an ineligible employer or in sectors such as erotic dance, massages, or escort services.
- Provide all the necessary documentation as requested by immigration officers and prove your intent to return home once your work permit expires.
Application Location & Entry Requirements
The Spousal Open Work Permit can be applied for from both inside and outside Canada. However, if you are applying from outside Canada, note that you must also obtain a visa to enter the country, as the work permit allows you to stay and work but does not, on its own, grant entry or re-entry.

The general processing time for the Spousal Open Work Permit application can range from 3 to 5 months, though this may vary especially if additional biometrics or documentation is required.
